             In the action of Borlay v. Primus Automotive Financial Services, Inc. and Ford Motor Credit Company, United States District Court for the Middle District of Tennessee, at Nashville (Civil Action No. CV-3-02-0382), the class representative, on behalf of himself and the class members, the individual plaintiffs and Defendants Primus Automotive Financial Services, Inc. and Ford Motor Credit Company, have entered into a settlement agreement.
